At Text Services, LLC, protecting your data and helping you communicate responsibly are central to how we operate. Since 2007, we have built our platform with security, privacy, and regulatory compliance in mind. Whether you are sending appointment reminders, marketing promotions, or internal team communications, we provide the tools and safeguards to help you do it the right way.

Messaging Compliance

The text messaging industry is governed by federal and state laws, carrier requirements, and industry guidelines designed to protect consumers from unwanted messages. We take these obligations seriously and build compliance directly into our platform.

TCPA Compliance

The Telephone Consumer Protection Act (TCPA) is the primary federal law governing text message marketing. It requires businesses to obtain prior express written consent before sending marketing messages, honor opt-out requests immediately, and maintain records of consent. Violations can result in fines of $500 to $1,500 per message. Our platform is designed to help you stay compliant by providing built-in opt-out handling, consent management tools, and automated do-not-contact list maintenance.

CAN-SPAM Act

The CAN-SPAM Act regulates commercial electronic messages, including certain types of text communications. We help our customers comply by supporting clear sender identification, proper opt-out mechanisms, and honest messaging practices.

CTIA Guidelines

The Cellular Telecommunications Industry Association (CTIA) publishes Messaging Principles and Best Practices that set standards for responsible business messaging. These guidelines cover proper opt-in and opt-out procedures, message frequency disclosures, content standards, and sender identification. Our platform and onboarding process are designed to align with these industry best practices.

A2P Registration

Application-to-Person (A2P) registration is required by major wireless carriers to verify the identity of businesses sending text messages. This registration process helps reduce spam, build trust with carriers and consumers, and ensure message deliverability. We assist our customers with A2P registration as part of our onboarding process to help ensure your messages reach their intended recipients.

Opt-In and Opt-Out

Text Services operates as a 100% opt-in platform. Every recipient must provide appropriate consent before receiving messages. Our system automatically processes opt-out requests when a recipient replies with STOP, QUIT, END, CANCEL, or UNSUBSCRIBE, and prevents any further messages from being sent to that number. We maintain opt-out records to ensure ongoing compliance with federal and state regulations.

HIPAA Notice

Our platform is not HIPAA compliant and must not be used to transmit protected health information (PHI). This includes patient diagnoses, test results, treatment details, medical records, or any other individually identifiable health information. If you operate in the healthcare industry, you may use our Services for general appointment reminders, office notifications, and similar non-clinical communications, but you must not include any PHI in your messages. It is your responsibility to ensure that your messaging practices comply with HIPAA and all other applicable healthcare privacy regulations.

Platform Security

We understand that the security of your data and your customers’ data is critical to your business. We employ multiple layers of protection to safeguard the information entrusted to us.

Encryption

All data transmitted between your browser and our servers is encrypted using SSL/TLS protocols. Sensitive information such as payment data is encrypted during transmission and processed through our PCI-compliant payment processor (Sage). We do not store credit card numbers on our servers.

Network and Infrastructure Security

Our infrastructure is protected by firewalls, intrusion detection systems, and continuous monitoring. We perform regular security assessments to identify and address vulnerabilities. Access to production systems is restricted to authorized personnel on a need-to-know basis.

Application Security

Our platform includes protections against common web application threats, including cross-site scripting (XSS), SQL injection, and cross-site request forgery (CSRF). We use Google reCAPTCHA to protect login pages, contact forms, and other form-based pages from automated abuse. Our login system includes progressive account lockout protection to guard against brute-force attacks.

Access Controls

Customer accounts are individually segregated to ensure that your data is accessible only to you and authorized users on your account. Our employees access customer data only when necessary to provide support or maintain the platform, and all access is logged and monitored.

Data Backup and Recovery

We maintain regular backups of customer data to protect against data loss. Our backup procedures are designed to ensure that your contact lists, message history, and account information can be restored in the event of a system failure.

Your Role in Security

Security is a shared responsibility. While we take every reasonable measure to protect our platform, there are steps you should take to protect your account:

Use a strong password: Choose a unique, complex password for your Text Services account and do not reuse it across other services.

Keep credentials private: Do not share your login information with unauthorized individuals. Each user who needs access should have their own account.

Monitor your account: Review your account activity regularly and contact us immediately if you notice anything suspicious.

Protect your contact lists: You are responsible for the data you upload to our platform, including ensuring that you have proper consent for each contact and that sensitive information (such as PHI) is not included in your messages or contact data.
