Our Commitment
Text Services, LLC is committed to providing a responsible, compliant messaging platform. We operate a 100% opt-in service and take a zero-tolerance approach to unsolicited messaging. This Acceptable Use Policy (“AUP”) outlines the rules and expectations for all customers using our platform and supplements our Terms of Use and Privacy Policy.
Every customer who uses our Services agrees to comply with this AUP. Failure to do so may result in warnings, suspension, or permanent termination of your account.
What We Consider Unsolicited Messaging
Any text message sent to a recipient who has not given proper prior consent is considered unsolicited messaging (commonly referred to as “spam”). This includes messages sent to purchased, rented, scraped, or otherwise acquired third-party lists where the individuals on those lists have not explicitly opted in to receive messages from you. We do not permit the use of third-party contact lists under any circumstances unless the contacts on those lists have provided direct, verifiable opt-in consent to your organization.
Consent Requirements
All customers must ensure that every recipient of their messages has provided appropriate consent before any message is sent. Depending on the type of message, this means:
Marketing and promotional messages: You must obtain prior express written consent from each recipient in accordance with the Telephone Consumer Protection Act (TCPA). This consent must clearly disclose that the recipient is agreeing to receive text messages from your organization, the approximate frequency of messages, and that message and data rates may apply.
Informational and transactional messages: You must have an existing business relationship with the recipient and prior express consent (which may be oral or written) to send messages related to an existing transaction, appointment, account notification, or similar non-marketing communication.
You are solely responsible for maintaining records that demonstrate valid consent for each recipient on your contact lists. Text Services may request proof of consent at any time, and failure to provide it may result in suspension or termination of your account.
Opt-Out and Unsubscribe
Our platform supports industry-standard opt-out keywords. Any recipient may stop receiving messages at any time by replying with any of the following keywords: STOP, QUIT, END, CANCEL, or UNSUBSCRIBE.
When a recipient opts out, our system automatically adds their number to an opt-out list and prevents any further messages from being sent to that number from your account. You may not attempt to circumvent, override, or re-add opted-out numbers to your contact lists. Doing so is a violation of this AUP, federal law, and carrier policies, and will result in immediate account termination.
Prohibited Content and Activities
In addition to the prohibited uses outlined in our Terms of Use, you may not use our platform to send messages that contain or promote:
Unsolicited commercial messages to individuals who have not opted in; deceptive, misleading, or fraudulent content; phishing attempts or messages designed to collect sensitive personal information under false pretenses; content that impersonates another person, business, or organization; illegal products, services, or activities; hate speech, threats, harassment, or content that promotes violence or discrimination; adult or sexually explicit content; illegal drugs, controlled substances, or related paraphernalia; gambling or wagering activities where prohibited by law; malware, viruses, or links to malicious websites; or any content that violates applicable federal, state, or local laws, carrier policies, or CTIA Messaging Principles and Best Practices. Message Content Standards
All messages sent through our platform must clearly identify you or your organization as the sender. Messages must not be misleading about the identity of the sender, the purpose of the message, or the nature of any offer or promotion. If you are sending marketing messages, your initial message to any new contact must include your business name, a description of the messaging program, message frequency disclosure, the statement “Msg & Data Rates May Apply,” and clear opt-out instructions.
Monitoring and Enforcement
Text Services reserves the right to monitor messaging activity on our platform to ensure compliance with this AUP, our Terms of Use, and applicable laws. While we do not routinely review the content of individual messages, we may do so when we have reason to believe a violation has occurred or in response to a complaint.
If we determine that a customer is in violation of this AUP, we may take any or all of the following actions at our sole discretion:
First violation: We will contact you to discuss the issue and provide an opportunity to correct the behavior. A formal warning will be issued.
Repeated or serious violations: Your account may be suspended immediately while we investigate. Depending on the severity, suspension may be temporary or permanent.
Egregious violations: Your account will be terminated immediately without prior warning. This includes sending messages to recipients without consent, ignoring opt-out requests, or sending prohibited content. No refund will be issued for accounts terminated due to AUP violations.
Reporting Abuse
If you have received an unwanted message sent through our platform, or if you believe one of our customers is violating this AUP, please contact us at abuse@textservicesllc.com. Please include as much detail as possible, such as the phone number the message came from, the content of the message, and the date and time it was received.
We take every report seriously and will investigate promptly. The identity of anyone reporting abuse will be kept confidential.
If you wish to stop receiving messages from one of our customers, you may reply STOP to the message at any time. You may also contact us at abuse@textservicesllc.com and we will ensure you are removed from the sender’s list.
Your Responsibility
As a customer of Text Services, you are ultimately responsible for understanding and complying with all applicable laws and regulations governing your messaging activities, including the TCPA, CAN-SPAM Act, CTIA guidelines, and all applicable state laws. This AUP is not a substitute for legal advice, and we strongly encourage you to consult with legal counsel to ensure your messaging practices are fully compliant.
Changes to This Policy
We may update this Acceptable Use Policy from time to time. When we make changes, we will update the “Effective Date” at the top of this page. Your continued use of our Services after the effective date of the revised policy constitutes your acceptance of the updated terms.
